AFFILIATE POLICY

This Affiliate Policy ("Policy") sets forth the terms and conditions for individuals or organizations ("Affiliates") who wish to resell services offered by Market Momentum ("we", "us", "our" or "our"). By becoming an Affiliate, you agree to abide by the terms set forth in this Policy.

Affiliate Agreement

1.1. Prior to becoming an Affiliate, you must enter into a separate Affiliate Agreement with Market Momentum. The Affiliate Agreement will set forth the specific terms and conditions governing the resale relationship, including pricing, commission structure and any additional obligations or requirements.

Affiliate Eligibility

2.1. To qualify as a member, you must meet the following eligibility criteria:

Possess a valid business license or registration, if required by the relevant jurisdiction.

Demonstrate relevant experience and expertise in the email marketing industry or related fields.

Maintain a professional and respectable image.

Affiliate responsibilities

3.1. As a member, you are responsible for the following:

Promote and market the services provided by Market Momentum in a truthful and accurate manner.

Assist clients in the onboarding process by providing guidance and support.

Manage customer relations, including handling inquiries, complaints and general customer service.

Collect payments from customers for services rendered, if applicable under the Reseller Agreement.

Comply with all applicable laws, regulations and industry standards.

Pricing and Commissions

4.1. Prices and commission structure will be agreed upon in the Affiliate Agreement. Market Momentum reserves the right to change prices or commission rates upon reasonable notice to the Affiliate.

Intellectual Property and Branding

5.1. As a member, you acknowledge and agree that:

Market Momentum's intellectual property, including but not limited to trademarks, logos and content, shall remain the exclusive property of Market Momentum.

You will not use Market Momentum's intellectual property without prior written consent, except as expressly permitted in the Affiliate Agreement.

Customer Data and Privacy

6.1. As an affiliate, you understand and agree to comply with all applicable data protection and privacy laws. You shall not misuse or mishandle customer data obtained through the provision of services.

Support and Training

Market Momentum may provide training, resources and support to Affiliates as deemed necessary and appropriate. The extent and nature of such support will be specified in the Affiliate Agreement.

Termination

8.1. Either party may terminate the Affiliate Agreement by giving written notice to the other party. Termination may be for convenience or due to a breach of the Affiliate Agreement. Upon termination, the Affiliate shall immediately cease all reselling activities and return any confidential information or materials provided by Market Momentum.

Limitation of Liability

To the extent permitted by applicable law, Market Momentum's liability to Reseller shall be limited to the fees or commissions payable under the Affiliate Agreement. Market Momentum shall not be liable for any indirect, incidental, consequential or punitive damages arising out of or related to the Affiliate Agreement.

Modifications to the Policy

10.1. Market Momentum reserves the right to modify this Affiliate Policy at any time. The updated Policy will be communicated to Affiliates and will replace any previous version.
